Terms of use

 

  1. These Terms of Use (“Terms”) govern your use and purchase of Hong Kong Airlines (HKA)’ branded merchandise (“Products”) through this Hong Kong Airlines Collection website ("Platform”). By using this Platform and/or purchasing any products via the Platform, you shall be deemed to have read, understood, and agreed to be bound by these Terms and Conditions.

 

  1. HKA reserves the rights, at its sole discretion, to change, modify, add or remove portions of these Terms, at any time. It is your responsibility to check these Terms periodically for changes. Your continued use of the Platform following the publishing of changes will mean that you accept and agree to the changes.

 

  1. The Terms (including any revised Terms) and other rules and instructions (if any) posted from time to time on the Platform constitutes the entire agreement between you and HKA.

 

  1. All prices shown on the Platform is real time. The final amount of the Products will be shown at the payment and confirmation page and you are strongly advised to confirm the amount before you proceed to the payment. Once payment has been completed and accepted by HKA, subject to clauses [6 & 7] below, no cancellation or refund shall be made.

 

  1. Disclaimer
  • Whilst HKA endeavours to keep the information appearing on the Platform up-to-date, HKA accepts no liability for the accuracy or completeness or use of, nor any liability to update, the information contained on the Platform. You should therefore verify the information obtained from the Platform before you purchase. Price and availability information, if featured, is subject to change without notice. HKA will not be liable for any losses and damages of any kind arising out of or in connection with the use of the Platform in violation of these Terms, unless such damages result directly from our willful actions or our gross negligence.
  •  The Platform and its information are provided on an 'as is' and “as available” basis without representations or warranties of any kind, express or implied, with respect to the operation of HKA and the information, content, materials and products included on the Platform. To the fullest extent permitted by law, HKA disclaims any representations and warranties, including but not limited to any warranties of merchantability, fitness for particular purpose and non-infringement.
  • HKA cannot ensure that any files or other data you download from the Platform will be free of viruses or contamination or destructive features. HKA disclaims any and all liability for the acts, omissions and conduct of any third parties in connection with or related to your use of the Platform. You assume total responsibility for your use of the Platform and any linked sites. Your sole remedy against HKA for dissatisfaction with the Platform or any content is to stop using the Platform or any such content. This limitation of relief is a part of the bargain between the parties.
  • The above disclaimer applies to any damages, liability or injuries caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction of or unauthorized access to, alteration of, or use, whether for breach of contract, tort, negligence or any other cause of action.
  • HKA reserves the right to do any of the following, at any time, without notice: (1) to modify, suspend or terminate operation of or access to the Platform, or any portion of the Platform, for any reason; (2) to modify or change the Platform, or any portion of the Platform, and any applicable policies or terms; and (3) to interrupt the operation of the Platform, or any portion of the Platform, as necessary to perform routine or non-routine maintenance, error correction, or other changes.

 

  1. Order placing on the Platform
  • The price payable for the products that you order (“Order”) are specified on the relevant item description page. Prices on the Platform may change without notice from time to time. All product prices shown on the Platform will be listed in Hong Kong dollars and are inclusive of any applicable sales and other duties and taxes.
  • Products shown on the item description page are subject to availability on the Platform. HKA does not guarantee the availability of such products until you receive confirmation that your Order has been accepted. The quality of image and colour of products shown on the Platform may vary from those actual product.
  • After entering required information, you will be invited to proceed to “Checkout” and complete payment via the available payment methods, which may include any of VISA, MasterCard, American Express and/or other payment methods available from time to time.
  • All transaction will be charged in Hong Kong dollars (which may be converted to the local currency of your payment method). Currently, we do not accept any other currency.
  • Once an Order has been made, we will send a confirmation email (“Confirmation”) to your provided email address to acknowledge that your Order has been received.
  • HKA may decline your Order or cancel your Order before acceptance or revoke acceptance of your Order at any time prior to picking up of the Order for any reason including but not limited to (i) your ineligibility to order the products (if applicable), (ii) the unavailability of any products that you ordered, (iii) the information that you provided is incomplete or inaccurate in any respect, or (iv) the product description, including price, is incorrect in any respect (HKA reserves the right to correct or update such information at any time). HKA shall have no liability to you and you have no claim against HKA if we decline your Order.
  • If HKA declines or does not accept your Order, HKA will process a refund according to your payment method for the purchased amount.

 

  1. Collection of Order
  • The Confirmation will tell you when your order will be available for picking up. You may pick up the Order directly from HKA’s designated collection points (“Collection Point”). For home delivery, it is only available to addresses located in Hong Kong.
  • You must bring along your Confirmation when you pick up the Order. When you make your Order, you must make sure the information you provide is accurate. HKA reserves the right to ask you to provide identification documents to verify your Order when you pick up the Order.
  • If you do not collect your Order within 24 hours from the available pick up date (“Pick Up Date”) as stipulated in the Confirmation, you should contact our Customer Service Team at hkacollection@hkairlines.com. We will use our reasonable efforts to contact you to confirm whether you still wish the Order. If you do not collect your Order within 72 hours from the Pick Up Date, your Order will be cancelled automatically. In that case, HKA’ sole obligation shall be to refund the purchase price in Hong Kong dollars via your original payment method.
  • If you wish to authorize a family member or friend (“Authorized Person”) to pick up your Order on your behalf, you may contact our Customer Service Team at hkacollection@hkairlines.com at least one working day before the Pick Up Date by providing the first name, last name, and contact information of the Authorized Person who will be picking up the Order. We will ask the Authorized Person to present his or her identification documents for verification during the pick-up.
  • If you wish to change your collection time, please contact us via our Contact Us page.
  • HKA warrants that the products that you ordered through the Platform will conform to the description on the product description page. HKA makes no other representation and warrant about the products and disclaims all implied warranties to the fullest extent allowed by law, especially with reference to consumer protection mandatory provisions.
  • When you or Authorized Person pick up your ordered products, you or Authorized Person will be asked to confirm in writing that the products that you or Authorized Person conform to your order and that the sale of the products to you is completed upon delivery.
  • The completion of the contract between you and HKA will take place when you pay for and collect the products. Title to any product you Order via the Platform shall pass to you when you collect the Product.
  • Adverse weather conditions may cause a delay in the delivery of your Order to the Collection Point.

  1. Promotion code issued by HKA (“Code”) may be applied to the purchase. The Code may not be used or combined with other coupons, promotions or special offers. There are separate terms and conditions applying to each Code.

 

  1. Proprietary Right
  • The Product/materials contained on the Platform, and that provided via your mobile and wireless devices, is protected by copyright. The information or description on the product/materials may only be used for your personal and non-commercial purposes. Except to the extent permitted by law, you must not use, copy, modify, transmit, store, publish or distribute the material on this website, or create any other material using material on the Platform, without obtaining the prior written consent of HKA.

    Trademarks (whether registered or unregistered) and logos must not be used or modified in any way without obtaining the prior written consent of HKA. The Platform, Products, technology and processes contained on this website may be the subject of other intellectual property rights owned by HKA or by third parties.

  1. The Platform may contain links to other independent third-party websites ("Linked Sites"). These Linked Sites are provided solely as a convenience to our visitors. Such Linked Sites are not under HKA’s control, and HKA is not responsible for and does not endorse the content of such Linked Sites, including any information or materials contained on such Linked Sites. You will need to make your own independent judgment regarding your interaction with these Linked Sites.

 

  1. HKA shall not be liable for any loss or damage arising directly or indirectly from your failure or omission to protect your personal data from being seen by other persons or otherwise obtained by other persons during the cost of effecting the payment online.   1. A valid credit card is required to complete the transaction. Credit card issuing banks may charge you an international transaction fee and the price may subject to currency fluctuation.

 

  1. Nothing in these Terms shall confer any third party rights or benefits.

 

  1. HKA reserves the right to amend these Terms, the decision of HKA shall be final.

 

  1. These Terms shall be governed by the laws of Hong Kong Special Administrative Region.

These Terms are written in the English language and may be translated into other languages. In the event of any inconsistency, the English version shall prevail.
